Definitively correct ?? don't even matter to me and here is why, I am not positive but, I am a pilot for 25 years and Manned airplanes can and are allowed to fly anywhere they generally want in unrestricted airspace down to 500' so is playing with a toy and the pleasure or desire to go higher...

Seems plausible !! I would also thing there might be some modified flight characteristics as well since I know the phantoms can do a few weird thing with the guards installed.

I think we need to let folks police themselves as the system is now set up to educate and do so, and fly our own drones rather than spending our time irresponsibly calling out others for maybe doing something wrong.

I'd guess those first customers were across the street or at least near by :) is how they were chosen. I am also predicting updates to the airspace rules in the USA as drones get more prolific for commercial delivery purposes and air apace will be given to commercial users above recreational...
