Depending on where you are exactly you might fall under that 1st tier of class b airspace in which, like SteelFlyer said, starts from the surface. If you really wanted to you could request permission from the ATC via the FAA but I doubt you'd want to wait for an answer... eh which might be also...

I'd have to self test then because everything I've seen online the mavic maintains a specific height in active track so if the subject ascends then the mavic does the same to maintain that distance; whereas the follow me mode wouldn't.
