For those following progress on BVLOS in CANADA, here is the feedback given during the 90 day consultation period, after introducing BVLOS amendments to the Canadian RPAS regulations last June. Details given in the hyperlink in the 3rd para.

Notice to CARAC members,
In April 2020, Transport Canada (TC) published the Notice of Proposed Amendment (NPA) – Remotely Piloted Aircraft Systems (RPAS), Lower-Risk Beyond Visual Line-of Sight (BVLOS). The NPA outlined Transport Canada’s intention to introduce regulations that would enable routine visual line-of-sight (VLOS) operations with heavier RPAS and lower-risk BVLOS operations. Subsequently, TC published a fee proposal and proposal for an RPAS Medical Standard to support the NPA in 2021.
To further advance this regulatory proposal, on Saturday, June 24th, 2023, TC published proposed amendments to Part IX of the Canadian Aviation Regulations in Canada Gazette, Part I - Regulations Amending the Canadian Aviation Regulations (RPAS – Beyond Visual Line-of-Sight and Other Operations). This proposal would allow routine BVLOS operations with RPAS up to 150 kg away from populated areas in uncontrolled airspace at low altitudes and includes routine VLOS operations with RPAS up to 150 kg.
The 90-day consultation period for the proposal in Canada Gazette, Part I ended on September 22nd, 2023. TC received 346 comments submitted through the Online Regulatory Consultation System (ORCS). All of the comments are available online here (with exceptions for confidential comments, comments from other Canadian or foreign government departments, and comments with personal information or profanity). TC prepared a “What We Heard Report” to provide an overview of general themes observed during the virtual consultation sessions and written submissions received online. The report summarizes the proposed regulatory framework, provides an overview of the consultation sessions, and identifies the key themes we heard from stakeholders. The What We Heard Report is now available online here.
TC would like to thank all stakeholders who participated in this consultation process. We received a lot of insightful comments through ORCS and verbal feedback through our Q&A sessions. We will be reflecting on and using this feedback as we move towards the publication of the regulatory amendments in Canada Gazette, Part II, which is targeted for late 2024.

En avril 2020, Transports Canada a publié l’Avis de proposition de modification (APM) – Les systèmes d’aéronefs télépilotés (SATP) - au-delà de la visibilité directe (BVLOS) à faible risque. L’APM présentait l’intention de Transports Canada d’introduire une réglementation qui permettrait des opérations de routine en visibilité directe (VLOS) avec un SATP plus lourd et des opérations SATP BVLOS à moindre risque. Par la suite, TC a publié une proposition de frais et une proposition de norme médicale pour les SATPs pour soutenir l’APM en 2021.
Pour faire avancer cette proposition réglementaire, le samedi 24 juin 2023, TC a publié des propositions d'amendements à la Partie IX des Règlements de l'aviation canadien dans La Gazette du Canada, Partie I - le Règlement modifiant le Règlement de l’aviation canadien (SATP – opérations au-delà de la visibilité directe et autres). Cette proposition élargit l'APM pour permettre les opérations de routine BVLOS avec des SAPR jusqu'à 150 kg loin des zones peuplées dans l'espace aérien non contrôlé à basse altitude, et inclut les opérations de routine VLOS avec des SATP jusqu'à 150 kg.
La période de consultation de 90 jours pour la proposition dans la Partie I de la Gazette du Canada s'est terminée le 22 septembre 2023. TC a reçu 346 commentaires par l'intermédiaire du système de consultation réglementaire en ligne (SCRL). Tous les commentaires sont disponibles en ligne ici (à l'exception des commentaires confidentiels, des commentaires provenant d'autres ministères canadiens ou étrangers et des commentaires contenant des informations personnelles ou des blasphèmes). TC a préparé un rapport sur ce que nous avons entendu afin de fournir une vue d'ensemble des thèmes généraux observés lors des sessions de consultation virtuelles et des soumissions écrites reçues en ligne. Ce rapport résume le cadre réglementaire proposé, donne un aperçu des sessions de consultation et identifie les principaux thèmes abordés par les parties prenantes. Le rapport sur ce que nous avons entendu est désormais disponible en ligne ici.
TC aimerait remercier tous les intervenants qui ont participé à ce processus de consultation. Nous avons reçu de nombreux commentaires perspicaces via SCRL et des commentaires verbaux lors de nos sessions de questions-réponses.
