It's definitely illegal. No different than shooting at an airplane. Don't do it.

If you intentionally fire a weapon into the air you are committing a FELONY. If you accidentally discharge a weapon you will still be charged with a misdemeanor "illegal Discharge". If that accidental Discharge happened within a certain distance...

The Hasselblad sensor on the Mavic 3 Pro is F2.8 on the fast end, but a larger sensor compared to the 3S F1.8 1-inch sensor, so all things considered it's probably pretty equal or negligible difference in low light.
