That's a pretty thoughtless response. A thoughtful one considers the reality of time and resources. One of the unfair aspects of life, sometimes you're simply screwed. Trying to fight it just screws you more. Personal decision.

No argument with any of the above except one: You vs. the US Govt. How much money and time are you willing to spend to "enforce your rights"? If only it were that simple.
