It's even simpler than that. There is a TFR in place; the drone shouldn't have been there at all.

There was a collision. The manned aircraft had the right of way. The drone was obligated to give way. No logic or courtroom cleverness could prevail over those hard facts.

And a responsible pilot shouldn't require a TFR to know that it was entirely wrong and dangerous to be flying in that area with search and rescue operations in progress and people's lives hanging in the balance.

Well, I disagree. I think it a pretty effective anti-theft feature that does actually reduce theft, especially for the more expensive models. MHO
