You retain copyright to your images unless you specifically give it away. However, once you post it on Instagram, it can be reposted within that platform, which would not constitute breach of terms.
If they used it on their external website, you'd likely have a case to win.
This is really not surprising given that P3 cameras had larger sensors and were overall much larger than the Mavic Pro camera. I loved the quality I got from my P3A, but the drone was just too large to travel with => thus I'm stuck with MP's camera gimmicks while somebody with a car is enjoying...
