If a person was (high or not) on prescribed medication and flying a drone would that person be in trouble?
Can you Drink and Drone if you are below .08?

Well any impairment is going to affect your ability to fly safely. .08 will get you a DUI here in MS.
Sure lots do it drinking or stoned but JMO I wouldn’t suggest
it. Might make you be braver than your ability to fly and then
there you are with a tore up drone and hopefully that’s all.

May fall under something like 'reckless and/or careless operation of an Unmanned Aircraft'. Not a DUI charge, but can still carry heavy fines / fail time.

However, I have no idea if that even applies to drones or not. Furthermore, if you ran into any trouble while flying, the officer may just tell you to land and move on...

Well, there’s this from the FAA: “Never fly under the influence of drugs or alcohol.”

Regardless of whether there are specific penalties for flying under the influence, there are always liability issues if you crash and hurt someone or damage property.

The FAA is very specific about not flying while under the influence of alcohol or drugs which impair. Why are you even asking? Something you do or plan to do? Where do you fly? Just so I can avoid the area.

IIRC the FAA rules state you can not operate sUAS within 8 hours of alcohol consumption.

Same applies for flying real aircraft, 8 hours bottle to throttle. But really, you should have more time between the two.
