Another fear I have is the 3000 fine ... the minister said that it gives officers the ability to educate pilots to handing out fines .... too
Much discretion in the hands of some unworthy cops .... flying near airports isn't the same as flying near a building ... IMO

Do you honestly think these rules will stop those ppl already flying dangerously close to airports ... I assume that's who you are calling Yahoo!'s
 
I challenge anyone to find a space within Canada that is 75m away from an animal, person, car, or building.
I read that the explanation of buildings was not an individual building but a group, hamlet sized (not group of farm buildings, individual buildings) or within Built up areas...

And besides, What is an animal according to TC??
To me everything is. Including birds. So how can you argue that the location you are flying in doesn't have animals?

Someone has already said to me is that all it will take is an animal "lover" to call 911 when they see me flying when there are birds around, and it's all over. BTW, will not matter if you are on a MAAC approved site or not. The actual law will take precedent.

NO, it specifically states that the act does not apply at a MAAC sites or sanctioned events... this is most likely due to the fact that these sites are pre-approved flying zones for model aircraft, which a drone is still classed as....
 
I have to laugh how you guys think this order is all encompassing. It's not.

Say someone calls the cops because you're Mavic is flying at 90m or lower and a dog happens to run by you at some point. In order for LE to issue you a notice of contravention that indicates you were within 75m of that dog, they will need to provide some proof of this. Otherwise you go to the TC tribunal and shoot it down.

Take for example a speeding ticket while driving. A calibrated measurement tool is being used to indicate that you are over the speed limit. LE would need a measurement tool to show you that your Mavic was within 75m of any building, animal or person.

I could see this part of the order not making it to the final regulation in the summer, because it's not really enforceable. It will just waste a lot of LE time.

There are all kinds of laws that are not enforceable but are a real annoyance. The authorities can actually get you to court before the judge says, "Get this out of here! This is annoying!" It happens in other arenas, so why not here? It's naive to think this can't happen. Your drone will be confiscated as evidence, on the spot, due to the issue of "reasonable suspicion" and then you have to retrieve your stuff on top of all the annoyance this could cause. (think Canada's FORMER gun laws!) Better to throw out these kinds of laws, but socialists and communists never do. Do you think Marc Garneau is going to admit he made a mistake (or Trudeau for that matter)? He's an astronaut. I love astronauts but they do have attitude. They didn't get to where they are by being "pansies". Nuff said.

I don't know about that. Here's the wording on the legal requirements of the order:

"When flying a model aircraft (recreational drone) in Canada you must:

follow the rules of the Interim Order Respecting the Use of Model Aircraft
Transport Canada inspectors investigate reports of unsafe and illegal drone use. We may involve local police if other laws (e.g., the Criminal Code and privacy laws) have been broken."​
 
Allowing only a 90m height and 75m minimum over buildings or roads ECT gives just a narrow window 15m to fly within, this allows more confusion for the uav pilot and potentially more hazardous towards what the FAA are trying to protect....this does not make sense
