It still kept doing it no matter what I tried. Fan never came on. I bought it through Amazon prime so I am sending it back

That's probably a good idea. It sounds to me like you've got a bad fan, which is leading to overheating.

I have let my sit on the table for several minutes while updating FW and going thru the menu check things out and making adjustments. The fan is running all the time, the bird never shut down by it's self, it didn't seem to get that hot to the touch when I shut it off and picked it up.
