I have been flying DJI drones for over 4 years now. The Mavic Air for 1.5 years. There is no false advertising! I have found when issues such as yours occur it is 99% of the time some form of pilot error.
If you are out of LOS technically breaking the law. BUT, within reason and most will not say or do anything. Just know where your drone is, be aware of flying objects such as planes, helicopters, etc. Also do not go so far that if something were to happen you would be able to retrieve it.
