Defaults back to h.265

On 2 seperate occasions, taking probably my coolest shots, the drone has defaulted back to h.265. I really only use my phone to download the videos, and of course you cannot download h.265. Anyone else experience this issue?

If you've changed your frame rate up, it'll force to h.265.
