Hello All,
I am a new owner for the Mavic Pro. I have watched many youtube videos and spoken to many of my friends who own drones and I was ready to fly. I took my drone to my back yard and was prevented from flying due to the fact i am within the 5 miles radius from JFK. However I have seen a neighbor fly all his DJI drones with no issue. How is that so?

You’re going to need permission from JFK ATC though. Also need to notify any uncontrolled airports within 5 miles.

It's not technically a question of permission - the requirement in 14 CFR Part 101 is just to notify them.

101.41 (e) When flown within 5 miles of an airport, the operator of the aircraft provides the airport operator and the airport air traffic control tower (when an air traffic facility is located at the airport) with prior notice of the operation.

However, the FAA has attempted to require more stringent regulation of recreational flights in Class B airspace, which this would be since Class B surface extends 7.5 nm around JFK.

Recreational operators are required to give notice for flights within five miles of an airport to both the airport operator and air traffic control tower, if the airport has a tower. However, recreational operations are not permitted in Class B airspace around most major airports without specific air traffic permission and coordination.

Notice (not permission) within 5 miles (including hospital/private/commercial heliports. He will need to have permission in the JFK Class B airspace.

I was always under the impression that you need permission in class C and D as well, but don’t have time to research it now. You raised a good point!

The FAA really needs to revisit this stuff though. I live on a small certified but unused airport more than 15 miles from any controlled airport. I need to make 5 phone calls to be legal, yet if I take off from my airport in a certified aircraft I need not make ANY phone or radio calls!

I'm pretty sure that if you make a reasonable attempt to establish whether an airport is active and proceed accordingly then you will not have any problems with the FAA. In terms of the requirements for your manned aircraft - those have priority over sUAS operations. If it's non-towered airport then presumably you make a call on the Unicom frequency to notify other traffic before taking off.
