This photo is actually dimmer than actually seeing the Mav3 with your own eyes. The light was brilliant in the mid day sun. People may say the PIC doesn't have enough situational awareness, however, knowing the air traffic patterns and the fact that it was only 3000ft away any plane or helicopters nearby could be heard and seen way before getting too close to the M3, allowing the PIC to lower the M3 to below 100ft or simply move out of the way. The PIC also knew the direction the M3 was pointed because, she knew the position and direction of the light on the M3. Is it BVLOS? Not in my opinion, being that it could constantly be seen. Yeah, the drone can't turn much, or you would lose the light, but when it is rotated, the light is so bright you can see the drone again in 1 second. SEEING THE LIGHT ALLOWS THE PIC TO KNOW WHICH DIRECTION THE DRONE IS FACING.
