Drone in for DJI Repair... unnecessary costs?

Air 2s. I was flying fast (for me) sideways around the top of the rock as I was coming back from a long flight and battery was getting low so I thought I would buzz the rock. I saw the tree on the screen on the corner of the frame and tried to elevate real fast (mistake). I should have just paused, but I sort of panicked because my battery was low and wasn’t expecting the tree. If I was flying straight I would have seen it coming but I was focused on the top of the rock. Lesson learned. Refresh is 99$ for mine. It wasn’t out of warranty but they do not cover crashes - maybe if I stretched the truth but it was pilot error on my part. I’ve done some simple avoidance tests and they worked. I probably need to do some more sophisticated tests just to see what happens.
