hank, with all due respect, I can assure you that flying a drone over a person's private property in NC without permission can trigger criminal and civil liability. I

Presumably then, you can cite cases were people flying drones over other people's property without permission in North Carolina have been prosecuted? Three should be enough to be persuasive.

Its a new law. I am not so sure anyone has been sued over it yet. Even if there were cases they would be very hard to find unless they were appealed. The NC law is similar to laws in several other states. Fatback said he wished he could bring "heat" down on the persons responsible. I said he could bring "heat" down using the NC state law which was accurate.

No one would go thru a trial on a charge accusing you of violating that drone statute and no prosecutor would take you to court on it and risk the scrutiny. Instead the statute is use to get you to plea to a different charge like disorderly conduct or trespassing and just pay a fine and time served and don't do it again and you may or may not forfeit your contraband, depends on your attitude and cooperation when you are arrested and booked.

There has been lots of miscommunication or misunderstanding on some key points. The NC statute that has been cited is a civil not a criminal statute. It is intended to give people the right to sue drone operators who fly over their property conducting surveillance without consent. It exists alongside criminal statutes which prohibit things like stalking, harassment, trespass, nuisance, voyeurism, etc. There are many other states that have the same or similar laws which we have discussed on this forum for 3+ years. These statutes generally allow recovery of "actual" damages or liquidated damages per image, but sometimes only if published. Some allow for punitive damages. Most allow for recovery of all legal fees and expenses. Many including NC's allow the plaintiff to seek an injunction barring further overflights. I am not suggesting resort to such laws are for everybody or for anybody in particular. What I am saying is that if someone is flying drones on a regular basis at night over private property and creating noise and disturbance in NC, there is a way to try and find out who is doing it and why, and possibly stop it. The assumption I am making is that there is credible evidence of the overflights and where the drones originate.

According to the charts, it's that time of the year again where the planets are closet to Earth in the late evening so that's Mars and Venus....coming in for a landing at LaGuardia. 😊
this vid i made with cellphone setup for a time lapse attached to binoculers im pointing at a convoy im going to call it of these drones all lined up a path quarter mile wide or so maybe idk 3/4 mile long ( im zoomed to a view of maybe 100ft wide ? up were there at so your not seeing the full pic i am will get one made though)so right before daybreak going in to land these things stay up all night! no pitstops! all night long before heading to land spot there released the same way next eveng about sun down 5 to 6 at a time i have gotten close enough to watch them rise to under cloud level turn lights on an start there snail s pace flight it looks like a big giat funnel when observed from a distance
 
Sorry but I can't accept any of this, it just doesn't add up.
Ask yourself, why would such a thing be happening, right where you are, every night for three years?
Why would they use too many drones to count them and why would they fly at a snail's pace for the whole night
Who would be doing it and why?
What is there for them to learn by flying over the same area all night, every night?
Anyone who wanted to learn so much about your area could do it in daytime from a car.

They look just like stars.
cause im standing there looking at them an i am 58 years old an god blessed me with enuff good sense to know what im looking at that is with just my cell so can give you an idea of the numbers of these things i will make another using my binoculer cell phone setup the picture wont have the numbers you see here but there will be no question you didnt see the last vid? was foggy morning but if you realy wanted to see what im sharing you would not be questioning me im no pro at any of this filming pic taking stuff but i will get some better if the group here wants to see more i can get all you want i live with them

What about them makes you think they are drones?

You say you've been looking at them for three years.
You must have observed something about them that makes you so sure.

Look at any small grouping and it stays together for the whole 6 hours you were recording .... just like the normal movement of the stars around Polaris every night.

They look just like stars. cause there drones 3 years i have been watching these things multiply im a sportsman im outside all the time and i happen to have an interest in astronomy if i tell a man the berrys are ripe its best you go get yourself a basket i know what im looking at do you?

they are trying to imitate the star movement its stealth man theres even a lil dipper formation they imitate but this dipper moves around at will lol that vid i took with my cell to let you see the numbers coming out my next one will be magnified wont get the big slice of the sky but will get you some detail im figuring this photography thing out its a curve like anything else say if i didnt know better i would say darpa has some paid help up in this chat box hhhmmmm??????
