thanks I'm having problems with my video editing software so I'll using Youtube.
 
Be very careful here, your on or flying over tribal land and you could get into some pretty serious trouble. I am in the process of going through some issues with Gila River reservation and the GR Rangers came out and spoke to me about flying the drone over the reservation and taking pictures of the mountains and horses. Apparently someone didn't like the video's I have of the horses running and reported I and spooking and harassing them.

The Rangers said I can be in trouble and the legal council is looking at the flights over the land as trespassing even though I took off and landed on public land outside of the reservation.

Just be careful, not sure what's coming next in my case..

Tell them to drop it or you will start picking their casino and I'll join you and some other friends that fly drones.
It's ok to go on their land to gamble . And they have no problem picking our capital building. This is a very sore subject with me.tgey want their cake and eat it then send us the bill

Court date 7/18/2017
1 count $500
8 counts $15000

Get everyone to help out, going to need it. This will be interesting take off and land from an Arizona public highway and flight over reservation land in US Airspace bound by the FAA.

So what happened?
 
check with Azpilot61, He did go to court and was finds, His lawyer worked it down to very little. I've never had any problems, just onces was ask to leave the reservation by the tribe police.
 
So the Tribal Court found that he could be fined for flying over Tribal land, even though that is Federal Airspace? Since he said he took of from highway, unless that highway was also within tribal lands?

I not saying that flying over areas have to be respected, but I thought this is what happened in the City of Newton MA ... that the federal courts said the city had no right to regulate the airspace?

That’s how property rights work. I can invite you to my home or business at my discretion for certain purposes. That doesn’t give you the right to then come over whenever you want to do whatever you want without my permission.

Oh so if I don't invite the Indians on to US ground they are violating the law and can be arrested. :cool:. pipe dream.
Salty I don't know if you have any reservations around you we use to have a problem with what that police called beer runs. the Indians work stop at a circle K off of the reservation and grab a few 24 packs of beer and and run out the door. If they made it back to the Reservation they were home free. even rental car companies work not rent a car to an Indian that was living on a reservation because one on their it was like a different country. the rental car company had no right to get it back. unless they wanted to contact the FBI. I know it has changed some since the 80's.
Now I see your from Iowa which there is some Reservations there.
 
So we finally settled this thing on Oct 26. In Sept they took the original 8 counts and amended another 60 counts of charges so 68 counts total. Basically, trespassing, flying without a business license, archaeological surveying and a few others I can't remember. They wanted to confiscate any drones involved and I had to remove all video and pictures I took with the drones. They didn't want me to shoot any pictures that showed any part of their land (this didn't work out for them, they can't stop me from taking pictures) Also they had an issue with my flying aircraft and gliders over their reservation and had to have a special ok put in the court docs that if its an emergency landing they can't prosecute me for trespassing. Had to have permission to drive on the roads through the reservation to get to work etc.

I'm not going to get into the semantics of Airspace etc. We all know how that works. But once they lock in on you, you best be ready or it could end up a very expensive experience. Its their courts and rules and you have to play by those rules (very few lawyers can practice on the reservation, took me a while to find one.)

Anyway's, they stated they are upset about drones flying on the reservation (Yes they consider the airspace theirs, but when pushed backed down) Said they are starting to crack down on those that fly drones over their land. Basically cost me $500 for the fine and $5k for the lawyer. Which if I didn't have I'd probably be $20k in fines. They basically were not playing around and made it clear don't come flying the drones over the reservation.

I have not had any problems with the Indians Tribe at the location we fly. I even had Triable trucks drive by and wave. I've talked to a few of the farmers that work the ground.
