Roving TFR rules

My opinion follows: No worries, the 6th amendment of the Constitution is alive and well. Our justice system is built on the plea bargain process and unless you are foreign actor with nefarious intentions (which you could easy pickup that label) then you just need to bend the knee and you'll be allowed to permanently depart the hobby with a slap on the wrist. No one should be fighting against the government in federal court anyway, I think we all are pretty much aware of the futility; it's a long shot.

These regulations are primarily meant to force you to cooperate or prevent the new flyer from getting involved in the hobby because the stakes are too high if you screw up. I've never heard of any actual "criminals" going to jail over any drone violations so to me, these regulations are meant to contain and control the law-abiding honest flyers who make a mistake. In fact, a few major violators who have pushed back....ultimately nothing has happened to them either. It's up to you. Most people are just hoping to fly under the radar, that's the kind of life they live and it works for them. Personally if I ever get jammed up with one or more of these, I'll gladly hang it up.

I’m good with following the rules but the roving TFR has me a little concerned, and get a bag of popcorn for when Super Bowl has another drone violation.
 
There is a huge difference when you knowingly violate a TFR and "not actually knowing" you were not supposed to be there. To fly a Drone or any R.C. Vehicle in any state, you must posses a trust card, To get that Card You must take a simple test that reminds you to check and make sure you can legally fly there. So to Knowingly fly a TFR is NOT a good idea.
Even if you intend to state your belief in court, Your not gonna get much sympathy from a judge. The fines are extreme but a drone pilot will never face such huge fines for each violation, However if it gets to that point I am sure you can expect some sort of "audit" or investigation into your past flying activities and any violation they were gonna give you in the first place can be turned into a "few more" just by wording it differently on a separate form.
For instance if you are caught dive bombing the local Airport.... not only will you pay fines for that, but also "Impeding commercial traffic" x how many "commercial flight" you "impede" and dont forget any helicopters that couldnt takeoff because of your idiocy, Thats gonna run you 5,000 per...., and say you left your TRUST card at home while you were doing all this....Well you can just about double your fine because now they got you on operating an aircraft on airport grounds without the proper certificate! To face all this "junk" you probably gonna need a lawyer ( MO Money!!! )....You can see where this is going YOU Cant Afford The fines and other stuff!!! even if they are not as bad as stated.....Sure you may not spend much time or any in a jail but after a few Payments, You might wish they had just given you a little time and been done with it!!
Honestly Tho With the little time we have left .... To get in trouble flying a Drone is really never gonna happen to you unless of course you decide to fly over the Super Bowl or Do something Stupid and/or Cause an injury with your Drone. Then you will most certainly be Paying for your disregard for the rules.
Keep those around you (the public) safe ( That includes Flying over them!) and you will be able to keep what little money you have left after funding your Drone addiction.
Can you just imagine all the Drone idiots that would fill the Skies at a large news event or sports event if they Didnt "Scare" the pilots a little.
 
When I reached out to the FAA about this, they sent me the following "guidance". This is not law, and does not override the TFR, but you can use it to reason with any agent that rolls up. And if you land when they tell you to (notice I didn't say "ask" you to), you'll be fine.

Print out the attached PDF and carry it with you. And yes, it has my email address on it. Left it there on purpose. It also has Steve's email address, which it the standard UAS Support Center email address. I was also told this is a direct result of the activities going on in Minneapolis, although it is just as applicable for any other issues that pop up anywhere else in the country.

The FAA/DOD/DHS isn't going after every person who happens to be flying a drone when one of these "rolling TFRs" happen. They'll only use it to get you to land if necessary.

Air Aware and Air Control are both free ...no reason to be unaware of a TFR ...check either one of these prior to taking off.
Neither of those apps will show the roving TFRs. Because they won't be published. If that were the case, this wouldn't be the issue it's become.

That's because they were published TFRs. The roving ones mentioned in the NOTAM won't be published. That's the issue.

Air Control gave me no warnings when I tried to create a LAANC request for Feb 8th at 17:00. Clearly it's not taking the TFRs into consideration. (I didn't hit submit on the request obviously.)

The government has determined that it is unwise to publish these "roving TFRs" since it would likely give away the current location of the secret police forces. Therefore "roving TFRs" are not revealed but they do exist and will be enforced by....the secret police. How convenient.

I'm not understanding the benefit of showing this. If you're called our for violating a TFR, it seems that presenting this just shows that you understood that you were required to check for TFRs prior to the flight. What am I missing?

There is the legality of the TFRs, and then there is the official guidance from the FAA's UAS Support Center. In the heat of the moment, if an official rolls up on you during the TFR, you can show them this and let them know that once your were informed that a TFR was active, you landed immediately.

It's basically a good way to diffuse a possibly awkward situation by using an official FAA communication.
