Well, for one thing, the Predator is owned and operated by the military and the helicopter would almost certainly be used by civilian police. Some of us object to using the military on our own citizens exercising their Constitutional rights.How does "Spying" come into play. Those "protestors" are in plain sight. There was no need for aerial surveillance, and no justification whatsoever for employing the military to surveille citizens acting civilly and lawfully. And there's no need for quotation marks required around protestors.
You seem to lump all protestors together and brand them all as violent arsonists, looters, and rioters. I might guest thgat you're basing your viewpoint on the statements of the fellow who famously proclaimed, "They're eating the dogs! They're eating the cats." The same fellow who declared all protestors to be scum.

DHS is a federal law enforcement agency.
