Utah Code 76-6-206 and a fast flyover at 350-400’ AGL?

Would Utah Code 76-6-206 prohibit a person from only momentarily flying a drone in a single straight line without any lingering across private property at 350-400’ AGL to get to and back from a photo shoot of a landlocked parcel? I have permission to do the shoot but not to access the property through the easement.

We in California have the same law. If you are not filming a property that you are "lingering" over in most cases you will be fine. If however you need to Fly over other peoples Property to do your shoot It's best to inform them!! They CANNOT stop you from Flying over and around their property, What they can do is stop you From "lingering" while filming or Harassing them Basically. It is best that you inform those in the area you will be flying. If they have any complaints Apologize and tell them to seek the advice of the authorities. We fly drones all the time over others property here and the only time I have heard of someone being Charged is if they were filming without permission ( with evidence) OR Harassing someone with a Drone on that persons property. I don't think you will have any hassles with it honestly....Unless you surprise the neighbors then they may complain but I don't think they could charge you with "lingering".. Filming while overflying a property no matter whom it belongs too is perfectly legal.

It’s a weird situation- We’re dealing with a property owner who can say yes or no to contractors using the easement, and without his permission (as per the easement legalese), I can’t get to the customer’s property, but it’s close enough to fly to!

I would fly to it He could complain but you are not breaking the Law In Cali we have had that law for years its mainly for "gawkers", "Harassers", and Paparazzi that like to film people over their fences

Yeah, I’ll just go when he’s not there and get a ride in with the customer.

How is it an easement if the public can't use it?
Maybe I used the wrong term? It’s a granted access agreement stated on a contract between the owner/seller and guy who purchased the land from him- the buyer can access it , but needs to let the seller know who (besides his family) is coming in through the access area and get approval for it. The guy is worried about his stupid cows or something.
 
I wanted to add that under that law, at least here in Cali no matter where your Drone is at If you point your Camera in somebody's direction without permission and make that person the Main Subject for more than a min or so, you can be charged with "lingering" for the purposes of filming without permission. In some Towns they have banned selfie sticks because of that law.

I assume in California, the law has to do with private property and if the person is present and interfered with though, correct? In Utah it’s stricter and includes “entering over a person’s property” with no mention of taking photos or a person having to be present.

In California, The intent will dictate what happens really. If you are over someones properties, filming their property without permission you are breaking the law.The law was originally enacted for celebrities to keep people from spying on them with selfie sticks or climbing trees and filming them. If you film someones property and they are not there you can be sued and charged with Lingering. But if you film any persons house and publish it without permission nationwide they can sue you.

Yeah, you’re right about that, photo stock agencies will not accept photographs without property releases, some even if it’s public land.
