What are the requirments to legally fly out of line of sight?

I know that even with a Part 107 certificate, commercial pilots must stay within line of sight, so what license is required to fly out of sight? Is only military allowed to fly out of sight?
 
You would need a waiver from the FAA.

Am I correct in saying that in the UK the CAA have an exemption for FPV flying? General exemption E4185 with a competent observer and a number of other conditions you can fly out of sight.
