The drone is not over the crowd at all.....
At least on this picture.
Actually looks like it quite a fair distance away horizontally.

Not sure about the permissions to fly over buildings where the photographer is based though.

Btw. I'm not saying this is a good idea, but it might be legal. Over here in Germany we need at least 100m horizontal distance.
I would not fly like this over crowds.

I would think that if the camera is pointing straight down then the red X would give you the center of the frame and show what you are over.
Well it would be stupid to do that. No problem to tilt the camera slightly up. Get a shot from the side and get rid of the distortion in post.
 
I wasn’t suggesting it would be a good idea I was just trying to point out a way to tell what object or objects the drone is over
If the drone would be on the center x location you would not see the complete bonnets of the cars parked on the building rearside.
 
From the shadows, views of the exterior walls of the buildings, and A/C units, etc, he is below the X mark over the grass between the sidewalk and the building. Legal even in the US, however, still close enough that if the bird came down and spiraled or toppled, there would be a risk of it hitting the crowd.
 
In the UK, we'd have to be 150 metres (500 ft') horizontally from a 'crowd' like that, and due to our 120 metre (400 ft') height restriction, under those rules we'd not be able to overfly either.
