I think many people realize if they film while they are flying and not following the FAA rules they may be creating evidence that could be used against themselves. It would be the actions of the flight rather than the actual usage of the image/footage the FAA might be concerned with, your images...

I use the Mini 4 with no problems (knock wood),but use it with a Mavmount and rarely disconnect the controller from the Mavmount. The IPad is easily removed from the Mavmount if you need to.
