Getting arrested. But found a cool spot

You can beat the rap, but you can't beat the ride downtown.

I know this from having dealt with Homeland Security shooting in the NJ Meadowlands. No matter how many times I tell them, most terrorists don't use a tripod they fail to see the logic.
 
Another option would have been to decline their "invite" to the police station. They can only have you go there under two situations... you are arrested or you voluntarily go.

Back in the 80's I used to live nearby in Tempe at the intersection of Price & Broadway if you're familiar with that area. Nearby the university.

Refusing to comply doesn't win you a pass, it gets you the cuffs. If they want you, you are going one way or the other, and it is 100% THEIR choice.

I work in the 5 story building a few hundred yards west of there. I have been thinking of flying from our 5th floor balcony as it provides an unobstructed view of the surrounding area. I recently had a visit from two friendly Gilbert police officers flying in the same place as Thomas B. They wanted to know where my drone was and what could I see when I zoomed in. I laughed and said there is no zoom and showed him my screen view of us. I was about 350 ft up and over 1,000 ft away over farm land. The officers laughed as well and went on their merry way.
 
Happy to hear it all worked out and you took the high road and kept yourself from being arrested, hopefully the officers learned something from the experience. Fly save our friend.
 
Wow, what the reason they hassled you for to begin with? I mean what laws did they think you violated? This makes no sense to me whatsoever

Been here since 1980... when the 60 dead ended at Power. Growth has been phenomenal. Live out near the Santan Mtns now.

Likely the same officers you saw. Think they use the canal road as a shortcut. Hope to see you there soon.
 
So I am in a parking lot as we speak. Taking video of an airplane that is like a memorial but no one is around. No airports and they are trying to figure if they want to arrest me for trespassing or wrote a ticket because I have a service animal.

After reading all the comments in this thread, I have several questions...
1) were you arrested? Did you ask the reason for the encounter if not arrested?
2) were you placed in restraints and/or transported to the PD in your vehicle or the patrol unit?
3) did they deliver an apology or explain why you were detained or asked to go to the PD?

Without knowing exactly what was said or happened, it is hard to assume anything.

However, if I was in the same position and knowing NO laws had been broken after being informed I was going to be arrested w/o reason or a charge, I would immediately request a SUPERVISOR be summoned to the scene to explain the violation of my civil rights.

I would the contact a constitutional lawyer with the videotape of the incident after the fireworks have settled.

Just saying...

I was placed under arrest when I arrived at the police station, that is when they removed my service animal from me. During the boooking process, the sgt came over and had words with the arresting officer and they cut me loose but I kep the ticket and the paperwork they give when they arrest you. Even though they released me, I am still goning to the court connected to that police station so that I can state my case. I was placed in restraints after I entered the police station, at this time they put my dog in another room.
We do have video of the entire thing.

I saw a cool place to fly. Public property flying as a hobbiest. The police showed up. Asked me to stop and talk to them. I explained that leaving an aircraft in the air without being able to see it was against the law and I asked to please allow me to land it before we continued.

I landed.

I was told that the City of Chandler does not allow drones. I then explained to him that the governer of Arizona signed a bill that says towns and cities can not create their own drone laws.

I was then told to put my equipment up and was asked to follow them to chandler PD.

I arrived, I went in the front door, they took me in the back and booked me. I was in custody for maybe 20 minutes before I heard a very loud voice coming down the hall. He was angry, I could hear him. He opened the door and said you are free to go. We made a mistake. We would like the ticket back. I refused and told him that this needs to go to court and needs be brought up at the next city council meeting. I left with all of my ****, they tried to take the sd card out of the mavic and go pro but were unable to.

I have already contacted my attorney, yes, I have an attorney on retainer for this kind of **** because flying drones is how I make money. He said to meet up with him tomorrow and we will go to the court together, talk to proscutors and the judge together and then the police officer's supervisor. I have already dropped off the sd cards at the attorneys office mail slot.

I broke no laws. My attorney is an aviation attorney. I will fill you guys in monday afternoon.

I complied bud. 100 percent complied with everything they said. Arguing and being a jerk will get you arrested. I don't know if you misread something bud but I complied with the officers 100 percent.
 
Happy to hear that at least the supervising officer knew something of the law pertaining to drones. I will avoid flying in Chandler for now. Gilbert police have approached me once, asked what I was doing, and we had a cordial conversation after I pointed out my M2P about 250’ up and 500’ out (brought her home before the conversation). They said it was OK to fly there over fields of crops and major drainage channel.
Have a son on Chandler PD. I think I’ll discuss the Chandler drone situation and city ordinances with him.

I am so glad someone asked for details (again), I was not sure whose side I was on until it was properly detailed a couple of threads back. Looks like they jumped the gun on this based on the OP's description of events.
 
For those wondering. Here’s a link that contains the Arizona state law regarding drones.
It clearly states that only the state can make laws on this. Other interesting parts also, like requiring cities with more than one park to allow drone flying in at least one of them. The applicable federal laws are also listed as AZ is 90% plus federal land and Indian reservation.

I know. I fly a lot on the reservations. I just let them know im there. They tell me where I can and can not film and I give them a copy. They love it, I got some work fromt he casinos because of that.
