in the past year in NJ I've seen a couple bad accident cleanups actually recorded by drone and sold to the news.
Drone wasn't getting in the way of anyone and there were no helicopters in the area.

Is that legal? seems to be illegal. but are there legal ways to go about it?

If the incident commander gives you permission (and you are otherwise following all the other rules, ie not flying over people)
