RTH, how trust worthy?

Just have the controller with you and do a hand catch landing. Take good leather gloves - like motorcycle gloves with gauntlets - and perhaps a few practice catches at home before you go.
Set your RTH location and take off. Keep the controller with you.

Yes. All legal.

It would always be in line of sight of me but I wouldn’t have the controller with.
If you won't have the controller with you, someone else must have control of the drone.

Let's approach this from a manned aircraft perspective.
A pilot can engage autopilot at any time, however, that doesn't mean he can just go in the back of the plane and take a nap. There MUST always be a PIC in the cockpit to take control of the plane in the case of an emergency.

But the OP wanted to leave the controller on the beach. Therefore, impossible to take control should he need to. That's why I said illegal.

Just like driving You cant operate a Drone while operating another vehicle thats a distraction.. You yourself are breaking the rule of distracting the pilot and you are liable for any accident you have that is caused by you lol..You could be reported by yourself to the FAA and face fines under 18 USC.32 LOL

Well honestly, I heard the FAA and the FBI and other authorities tell us conditions where drones were flying that I previous thought were illegal (over 400 ft, without LAANC, beyond vlos, during TFR), they say it's legal. They literally said drones flying all over town all by themselves, the few ones they have seen and have been unable to local the pilot or the homepoint, flying in place where they have no business flying, are legal and there is no harm or threat to anyone. I'll take their word for it. So yes, I'm starting to change my mind what is ok and what is not ok. Will I do it myself, probably not. Will I continue to tell another hobby flyer what they are doing is illegal? For me personally, those days are over. lessons learned.

So do we also believe the Waypoint function that allows the flight to continue upon disconnect is also illegal? Are we asking for the US to ban that particular piece of the function as they have in Europe?

I've already given the example of dropping your controller in the ocean and therefore you are unable to take control of your flight until it lands, is that now an illegal flight?

Please show me the regulation so we can dissect and nitpick it apart notwithstanding the FAA doesn't care to enforce any of it.

It all depends on what you are comfortable with.

Plenty of videos showing FPV flyer flying without a spotter.

Every video posted is not always about what someone can get away with legally should they get hauled into a courtroom or in front of the FAA. I think the latter took a big hit and I think it is disingenuous to try to pretend like nothing has changed.

You didn't answer my question
As far as dropping your controller in the ocean I suspect the FAA would take that into consideration. However, there is a HUGE difference in dropping it in the ocean and intentionally leaving it on the beach

You are trying to sidetrack the point of this thread and the original question.

That's an if.

The only illegal part would be to not have the drone controller in hand.
One must be able to control the drone at all times (unless there is a failure where the drone would do droney things).

I get that but none of that is in the regulation: There is nothing about what would be taken into consideration or intent.

My advice to anyone else is always to follow the law. But I'm going to be the last person to "interpret" the law and tell this flyer that what he is suggesting is illegal. I get it if everyone else wants to stick with that but I simply don't agree and that's my opinion. If he wants to fly at 410 AGL, I'll tell him that's outside of the rules. If he want to leave his controller at home, I know there are Neo flyers that leave their controller at home if they even have one to begin with and since it's not illegal, I'm not prepared to go there; I'm not convinced. YMMV

Again, side tracking! If, as the OP said left the controller at home and he's out in the bay. You would have to be a complet moron not to see that this is completely illegal.

Again, stay on topic.
 
A NEO requires a phone to work, and the phone is the controller and people who use a NEO for self publicity never leave their phones at home.
