According to FAA the skies above one's property are open.
"The skies above one's property are open…" Right up to the point that the item (drone, kite, etc…) violates local law and ordnances (Nuance, violating privacy, depriving the owner of simple enjoyment, safety (kites near power lines). So many possibilities…

I am surprised that Lucy does not tell Charlie to just get off her property and tell him that they will "safely" remove the kite to prevent damage to the tree and either hire a "tree arborist with a lift" and charge him, or possible remove the kite herself and return all "three or four" pieces of it…

I do not remember if it was this web site or another site where a Brand New, Virgin, Mini 4 Pro owner (I would not call him a pilot…) flew his drone on its maiden flight right into the neighbor's tree. The neighbor refused to allow the "drone owner" to climb up the tree in an attempt to retrieve the drone… It was up near the top of the tree. They did allow him to hire a tree arborist with a lift to retrieve the drone from the street, but did not allow them onto the property. The "drone owner" was asked why he just did not claim it as a fly away and he had not bought the Care Refresh Policy…
