Thanks for the update. I checked everywhere for a follow up story, so far none. The article has a "submit a correction" button so I wonder if additional details were sent to the media would it be possible for them to also update their story to report more accurately to the truth. As with most drone stories, there always seems to be the initial report which is sensationalized and no follow-up until the flyer pleads.This was not exactly as it seemed. I only know of one pilot in this case from a private group (don't know if the others were the same) who was charged but they weren't charged with violating the no fly zone - they were charged with flying in controlled airspace. The Toronto police service officer that charged the pilot really had no clue since the CARs section used didn't apply to this category (microdrones). The charge was contested using the Transport Canada appeals process and it has already been dropped. Based on what I was told, it seemed to be a really sloppy encounter and it makes me believe the cops were told to "go out and charge anyone flying near here with something."
Like most incidents with drones at the state and local level, this will depend on several factors. Usually it is un-eventful (no pun intended) but when you have big events like the state fair and the infractions rise to the level of a misdemeanor (criminal), governments are risking their statutes and ordinance being tested in court unless they do the usual which is plea it down and let you go with a small fine or at most, forfeit the drone in lieu of jail time. Defendants find it much easier to put this behind them and cut their losses and live to fly another day but sooner or later, they're going to arrest the wrong person and it will go to trial....and we can go from there. Illegal surveillance state laws which prohibit *all* drone flights and results in a defacto no-drone zone cannot be allowed to persist else they spread to other states and before you know it, the states will "control" the NAS, not the FAA. Your Air Control app will be rendered useless.I'd like to know how the people flying over the fair in TN... fared
