Greetings all!

I've been engaging some of the local municipalities in East Central Florida regarding drone regulations in their parks. I'll keep this thread updated as I get definitive answers.

Brevard County:
No mention of sUAS on website
Confirmed that drone operations are allowed 2/18 by Steven Kimbal, Deputy Director, Brevard County Parks and Recreation. Follow State and FAA guidelines.

City of Cocoa Beach:
Discussion ongoing, surprisingly they didn't say no but were concerned about the neighboring airports.

Polk County:
No mention of sUAS on website.
Email reply stated no operations permitted.
Responded with 330.41 reference. Awaiting response.

Seminole County:
No mention of sUAS on website
Contacted to verify, awaiting response

Volusia County:
Launching or landing sUAS prohibited on website
Currently discussing with staff re: FS 330.41

If there are other municipalities you would like to see clarified, please let me know.

For those municipalities prohibiting sUAS operations, I am gently bringing Florida Statute 330.41 to their attention and discussing the pre-emption. So far, all the discussions have been very cordial and productive.

Interesting that the statute prevents any filming of public & private schools. I have no interest in doing so but could easily see myself inadvertently capturing one nearby to a community I'm filming.

As I was reading your list and statuses, I was thinking, "Well, of course they don't have any rules, the state of Florida says they can't."

Yeah, the problem seems to be convincing them the State’s preemption applies to them :)

Don't forget this exception. Pretty ironic the State will find a way around Federal pre-emption but then tell the locals government not to get involved but then give them similar exceptions. Not surprised:

(d) This subsection does not limit the authority of a local government to enact or enforce local ordinances relating to nuisances, voyeurism, harassment, reckless endangerment, property damage, or other illegal acts arising from the use of unmanned aircraft systems if such laws or ordinances are not specifically related to the use of an unmanned aircraft system for those illegal acts.

I don't see this as an exemption allowing the legal use/flying of drones. It only allows them to prohibit otherwise potentially illegal activity if done by drone, so long as the law making it illegal isn't specific to drones.
For instance, a peeping Tom statute would apply to drones just as it would any other method.
