I havn't had an officer cite because I havn't flown downtown BUT I have heard several others talk about that same law/rule. I'm not sure specifically which one it is, or specifically where to find that rule but wanted to post that I have heard that same thing. Maybe someone with a little more info can chime in?
I do know that you are allowed to fly inside building if that building gives you the go-ahead. Not likely to happen for random joes, but if you're flying commercially you dont have to worry about the faa. Otherwise flying commercially, or downtown, then having your 107 license and filing a flight plan with the faa that your drone will be in the air at X postion at X time should put you in the clear.
