Is it illegal to fly over people's property

I dont fly over people's property out of respect and if i do i stay right at 400 feet ,but if my mavic goes into failsafe it will take the straight line back home over people's property. What im trying to say is at sometime a person will have to fly over someones properly. Is legal to do so if necessary.

In the US, it's not illegal to fly over private properly unless it's a no fly zone, it's a threat to public safety, or you cannot clearly see the drone with your eyes while you're flying.
