The landowner lost, but now the case of Corner Crossing is scheduled to go to the Supreme Court. In the meantime, Eshelman filed a civil lawsuit against the hunters, claiming trespass by passing through the "airspace" above his property and seeking over $7 million in damages.

My favorite online lawyer has been covering this for years and it's so complicated that I can't even begin to understand the various twists and turns. Let's just hope if there is some sort of SCOTUS ruling, it is narrow enough that it does not impact aircraft (drones) and the NAS.

Just the fact that the “entitled” property owner is a pharmaceutical company executive pretty much says it all. “His” airspace should be trespassed by a cruise missile or predator drone.

There are two BLM parcels in my area that are landlocked and both of them have “private” roads leading to them that are now gated by the adjacent landowners. One I used to like to fly on and the other has an active mining claim that the prospecting club I belong to owns. I’m going to have to do some research on how the unlawful enclosures act may help with this, and who actually owns the roads, especially if BLM has a stake in it as well.

And as it happens, I have a big Dodge Ram, 4x4, to take him to the "Station" and in that same vain, I wonder if he has "Cattle Guards" and runs "Lamas" on that ranch of his?

Back in the late '90s, I saw a lot of this happening in Tucson on the Northwest side of town where the big new hilltop mega-homes were going in and they fragrantly fenced off all sort of trails… I was a volunteer with the National Park Services and I happily went out with a ranger to cut, clip, and tear down all that we found… But they had a lot more money to replace the fences than we had resources to tear them down and they usually won…

I wonder why the lawyers have not gotten the FAA to get involved... I wonder if it has to do with the fact that the hunters backsides do not create a hazard to aircraft since there are special rules govern being "Tethered" since the hunters feet are still on the ground; hence Tethered… L L . . .

While the FAA refers to it as a TFR, some argue it functions more like a permanent restriction due to its consistent application.

I think it is a temporary TFR with no expiration date... I think it's a lot like when you really messed as a kid and your mother told you that "you were grounded for the rest of your life..."

Epcot is covered (about 90%) by the TFR and he is probably inside the TFR...

That's called a distinction without a difference. It's about as permanent as a TFR can get not much different than the WH or DC. Even the government uses the word "permanent" twice. But I get it, FL has changed in the last decade, they have a "new" governor/sheriff in town and the TFR can come down overnight if he had it his way.
