Even though there are no obstructions when flying over open water to speak of, how would you go about being aware of other manned aircraft within the drone's vicinity and satisfying your obligation to give way to them?

Technically no still.
It seems to be a bit draconian, but I suppose the airspace authorities need a clear line with regards to safe drone operation.

That said, I'm as sure as the sunrise comes each morning, many will fly BVLOS in many cases, if something goes wrong in a very bad way, then it will hit the fan.
A very bad way is an incident with a heli or such, not just losing a $1000 drone in the ocean.

BVLOS = NO without a waiver. Even with a visual observer, you must be able to see the drone if pulling off the goggles or looking up from the screen.
