Having read many posts here about how hassle free claiming is from DJI is i decided to take cover out when i bought my mini 3 recently, i was therefore shocked to read this earlier, are DJI in the right here?

Morning oh wise ones. So I’m in a bit of a battle with DJI as I was flying my drone which lost signal and didn’t RTH, they are saying it was due to a low battery, I had 28% battery left but they’re not budging, as I say the signal shouldn’t cut out because the battery still had 28%. Should I either challenge it some more or give up and pay the DJI Refresh £219?

Maybe they are, maybe not.
But without seeing the recorded data from that flight it's impossible to tell.
He's not saying that DJI rejected a Refresh clain.
He's saying they rejected a warranty claim.

You'll need to post your flight log here for our post mortem analysts to review, to help determine what really happened, but nothing to lose by challenging it further with DJI for escalation. If your lost signal response was set to hover, they would likely be correct, but if it was at the default of RTH, and the Home Point was successfully set at your launch location at an appropriate altitude, it looks had it would certainly have enough juice to return home.

Sorry i should have made it clear its not my drone the article was posted on Facebook there was no data posted, if the battery was at 28% surely it should have been able to get back safely.

I will try to find the post and see if there was any data i didn't see it earlier.

As @Meta4 pointed out, DJI was only denying a free warranty claim, not denying the Refresh replacement, after paying the appropriate deductible for a so called ”Flyaway" which merely means the drone is unrecoverable.
